Overview

In some instances, a development approval will require the transfer of a land parcel to Council for public use, which may include parklands, drainage reserves, and/or land required for public utilities. Where the land is not eligible to be transferred to Council with the registration of a Plan of Survey, a separate transfer will need to be undertaken at a later date.

The following information is of note:

  • To enable the commencement of the transfer, all applications must include the associated Development Approval, Approved Plan, Land Valuation and Survey Plan.
  • It is mandated that any land parcel transfer required after the registration of the associated Plan of Survey is to be affected electronically via PEXA (an eConveyancing system).
  • A solicitor or conveyancer will need to be engaged by the applicant to act as the settlement agent throughout the transfer process.
  • Land parcel transfers are to be completed at no cost to Council and any associated fees will be payable by the applicant through PEXA.
  • Council’s fees will be supplied upon lodgement of an eConveyancing Land Parcel Transfer Application and are in addition to any settlement agent, PEXA and/or Titles Queensland fees that may be applicable.
